FAQ
Common questions.
Do I need to register my copyright?
While copyright protection exists automatically when you create a work, registration creates a presumption of ownership and validity that can make enforcement easier. Registration is not required to sue for infringement in Canada, but Clearview often recommends it for particularly valuable works.
How long does copyright protection last?
For works created today, copyright generally lasts for the author's lifetime plus 70 years.
What is fair use?
Fair dealing, Canada's analog to U.S. fair use, allows limited use of copyrighted material without permission, but only for specific purposes enumerated in the Copyright Act: research, private study, education, parody, satire, criticism, review, and news reporting. Whether a use is 'fair' depends on factors including the purpose, nature of the work, amount used, and market impact.
How do I stop someone from using my work?
Options include sending a cease and desist letter, filing a DMCA takedown notice for online infringement, or pursuing legal action. The best approach depends on the situation, and Clearview can help you choose the most effective and efficient strategy.
How does Clearview price copyright work?
Most copyright work is billed hourly or on a hybrid basis, since scope can shift quickly with infringement response, licensing negotiations, or DMCA workflows. Where the scope is well-defined (such as a single registration or a standard licensing agreement), a fixed fee is often available. You will receive a clear estimate before any work begins.
Do you work with clients outside of Ontario?
Yes. Clearview is an Ontario law firm but works remotely (as permitted) with clients in other provinces and internationally when the matter is within Clearview's practice scope.
